Vinyl Product Coverage & Duration

Liberty Fence & Railing warrants that its vinyl product line is free from defective workmanship and materials; its products against abnormal fading, peeling and flaking, or abnormal weathering and discoloration when under conditions of normal use and service; and only those products produced by themselves. This warranty shall be void if Liberty Fence & Railing products have been mixed with profiles not extruded by Liberty Fence & Railing.

This warranty extends only to the original purchaser unless the warranty is transferred according to the terms specified herein, is specifically intended to exclusively apply to homeowners only, and does not cover the cost of installation of any defective products or the cost of installation of any replacement product furnished under the terms of the warranty.

In the event of Liberty Fence & Railing vinyl products being purchased and installed on property owned by corporations, government agencies, public buildings (i.e. schools, libraries, etc.), or co-operative housing (i.e. gated communities, townhomes, etc.), or any type of premise not used by an individual homeowner, the warranty shall be 30 years from the date of installation.

Limitations
The coverage listed above does not apply to any failure, defect, or damage resulting from or connected with the following:

1. Accidents, altered finish, misuse, improper applications (such as the product being treated with chemicals, unless the chemical is approved by Liberty Fence & Railing), the improper installation of hardware, gates, or any accessory items, and the use of tools not intended or recommended for normal installation.
2. Any act of mother nature (i.e. tornadoes, hurricanes, ground movement, or other natural occurring severe storms).
3. Fire, air pollutants, normal weathering of surface discoloration due to improper installation, and/or machinery coming in contact with the material.
4. Damage from foreign objects, improper handling of the product, or improper solvents or maintenance not recommended by Liberty Fence & Railing.

Our 15-Year Labor Warranty

Liberty Fence & Railing warrants our workmanship for 15 years from the date of installation. Warranty is subject to inspection and determination of Liberty Fence & Railing. During this period, we will repair or replace any parts that have not been abused or misused.

Reporting Defects & Resolving Discrepancies

All defects or failures of the product must be brought to the immediate attention of Liberty Fence & Railing. All questions pertaining to the validity of this agreement shall be resolved in accordance with New York state law. Liberty Fence & Railing shall be the sole judge of whether or not the product is defective and whether the defect is due to manufacturing. Based upon Liberty Fence & Railing’s determination of the claim, the section or part of the product will either be replaced or a refund shall be issued at the prevailing cost of the section or part at the time of replacement or the original pro-rated price, whichever shall be less.

How to Transfer Warranty

This warranty is transferable by the original property owner to the subsequent property owner on a pro-rated basis from the original purchase date. Liberty Fence & Railing must receive a written request of transfer, proof of the original purchase, and a $100 transfer fee payable to Liberty Fence & Railing within 60 days from the date of real estate title transfer. Failure to request the warranty transfer to the new owner and pay the specified transfer fee shall relieve Liberty Fence & Railing of any further obligation under this warranty.

Only in the event of a transfer of the warranty as provided above, the warranty period will be prorated as follows: During the first ten years, Liberty Fence & Railing will, at its option, replace the product or refund the original cost of material based on Liberty Fence & Railing’s list price at the date of purchase. Thereafter, every five years Liberty Fence & Railing’s responsibility will decrease by 10% of the original cost of the material based on Liberty Fence & Railing’s list price at the date of the original cost for the remaining warranty period.

Fill Out & Mail Warranty

Please fill out and mail the warranty to Liberty Fence & Railing within 30 days of installation or purchase to validate the warranty.
